A meeting of the Stony Creek Association Executive Board was called to order by President Peter Brainerd at the Willoughby Wallace Memorial Library at 7:43 pm on Tuesday, January 2, 2001.

Public: 0
Minutes: Under “Paid Bills”, the supplies for Nina Smith should read $3.52, not $3.42. A motion was made/seconded and unanimously approved to accept the minutes as corrected.
Treasurer’s Report: There was no Treasurer’s Report. Nina will call David to get copy of the June 30, 2000 audited and signed, year-end fiscal report.
Bills: Motions were made/seconded and unanimously approved to pay the following bills:

Tax Collector: Taxes are still coming in.
Legal and Zoning:No report.
Police & Traffic: John reported that on two occasions roads were blocked by cars and unable to be plowed. The town ordinance calls for no parking on even-numbered sides of streets after a snow or ice storm. Board members noted that Andy DaRos did an excellent job clearing the sidewalks. Peter will give him a call to have him check and sand sidewalks where snow melts and re-freezes, mostly from Indian Point Road to Flying Point Road.
Maintenance: Three new refuse receptacles have arrived. Two were installed in Bayview Park and one by the post office. The old one by the post office was moved to Madeira Park next to the ramp. Sandra met with Ed Masotta giving him a check for the trash receptacles ($1090) and a letter requesting monies, which the SCA would match, for projects during the year 2001 ($1000 for refuse receptacles, $2000 for replacing of street signs and posts, $4000 for finishing of sidewalk repairs). The meeting went well and Masotta verbally agreed to our requests. He will want to put the signs out to bid and since we have specific ones in mind, we will need to give him detailed specifications on Seton’s signs. He also said resetting of the curbstones edgings Madeira Park is planned in the near future. We have not received a bill from Riccio yet, but if we do, Sandra will take it to Masotta requesting a check for half the amount.
John reported that he got copies of the State statutes relating to municipalities and sidewalks from Senator Aniskovich’s office in which there seems to be no requirement for a town to make abutters pay for repairs or replacement of sidewalks. However, the Town ordinance from the Branford Code book, Section 216-41 reads: "Every person owning any land upon or adjacent to which there is a sidewalk shall keep such a sidewalk at all times in a safe and convenient condition for the use of the public and shall forthwith, at this own expense, repair all defects in said sidewalk and remove therefrom all obstructions in any way endangering or impeding public travel upon the same." Section C: "If after notice, the property fails to comply with subsection A, hereof, the Board of Selectman shall cause the same to be done at the expense of the property owner. Said expense shall be a lien upon the premises adjoining such sidewalks and the Selectman shall cause a certificate of lien to be recorded in the Town Clerk's office within sixty days from the incurring of such expense." John has sent a letter to the moderator of the RTM asking this to be sent to the Rules and Ordinance Committee for review. He has drafted an amendment to it, including deleting the "at his own expense repair all defects in said sidewalk and". In addition, essentially removing it from the property owner's responsibility, he will try to add to paragraph A the following: "Any substantial defects which may constitute a risk to public safety shall be reported by said property owner to the Director of Public Works. If deemed necessary any repairs or replacements shall be the responsibility of the Town of Branford. Where driveways or other appurtenant uses are coincident with the sidewalk, any associated costs for repair or replacement over and above that of the basic sidewalk construction shall be the responsibility of the abutting property owner.” Regarding the new town dock, John also noted that the permit issued and the Commissioner signed it off about three weeks ago.
Administration: Nina will compile the worksheet for the 2001-02 budget and mail it to board members prior to next month’s meeting at which time the budget will be addressed. Board members need to come prepared to do the budget next month. Nina also noted that the Administrative Committee did not meet regarding conforming to rules and regulations, posting of minutes, agendas, etc. They will meet this month.
Old Business: Sandra has one price for scraping off paint and refinishing the summer house. She will get more.
New Business: None
At 8:20 pm a motion was made/seconded and unanimously approved to adjourn the meeting.
